These Terms of Service govern your use of the website operated by The Pool Table Dr. at https://www.thepooltabledr.net and your purchase of products or services from us.

Throughout these Terms, “The Pool Table Dr.,” “we,” “us” and “our” refer to The Pool Table Dr. “You” and “customer” refer to any person accessing our website or purchasing products or services from us.

By visiting our website, submitting an order, paying a deposit or purchasing products or services from us, you agree to these Terms of Service and all policies referenced within them. If you do not agree, please do not use the website or place an order.

1. Eligibility and Customer Information

You must be at least the age of legal majority in your state or have permission from a parent or legal guardian to use this website or make a purchase.

You agree to provide current, complete and accurate information when placing an order. You are responsible for ensuring that your delivery address, contact information, measurements, product selections and other order details are correct.

We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by the customer.

2. Products and Services

The Pool Table Dr. sells and services products that may include:

  • Pool tables, game tables and game-room accessories
  • Pool cues, balls, cloth and billiard accessories
  • Hot tubs, spas and related products
  • Saunas
  • Outdoor kitchens
  • Patio and outdoor furniture
  • Chemicals and water-care products
  • Delivery, assembly, installation, moving, repair and maintenance services

Products and services may vary depending on availability, location and supplier authorization.

We reserve the right to limit quantities, discontinue products or services, or refuse a transaction when reasonably necessary.

3. Product Information and Images

We make reasonable efforts to display product descriptions, specifications, colors, finishes, measurements and photographs accurately. However:

  • Colors may appear differently depending on the customer’s screen or device.
  • Natural wood, stone and similar materials may vary in grain, color and texture.
  • Manufacturers may change specifications, packaging or product details without notice.
  • Product photographs may show optional accessories or upgrades that are sold separately.

Customers are responsible for reviewing product descriptions, dimensions, finishes, options and order documents before purchasing.

If a product is materially different from what was ordered, please contact us so we can correct the issue.

4. Pricing, Taxes and Errors

Prices are listed in U.S. dollars unless otherwise stated. Applicable sales tax, delivery, freight, assembly, installation and other charges may be added during checkout or provided in a separate quote.

We reserve the right to correct typographical errors, inaccurate descriptions, incorrect pricing or other mistakes. If an error affects an order that has already been submitted, we will contact you before proceeding. You may approve the corrected order or cancel the affected item for a full refund.

Promotional prices and discounts may be changed or ended at any time unless prohibited by law. Discounts cannot be combined unless specifically stated.

5. Orders and Acceptance

An order confirmation does not necessarily mean that we have accepted the order or confirmed product availability.

Orders may be subject to supplier confirmation, fraud review, payment authorization, delivery-area limitations and product availability.

We may refuse or cancel an order for reasons including:

  • Incorrect pricing or product information
  • Suspected fraud or unauthorized payment
  • Product unavailability
  • Delivery or installation limitations
  • Quantity restrictions
  • Violations of these Terms

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

6. Payments and Financing

Payment is due according to the terms shown at checkout, on the invoice or in a written sales agreement.

Financing, installment payments and buy-now-pay-later services may be offered by independent third-party providers. Approval, interest rates, fees, payment schedules and financing decisions are controlled by those providers and are subject to their separate terms.

The Pool Table Dr. is not responsible for a third-party financing provider’s approval decision, account administration or lending terms.

7. Deposits and Special Orders

Certain products require a deposit or full payment before we place the order with a manufacturer or supplier.

Special-order and custom products may include products ordered in a customer-selected size, finish, fabric, color, configuration or combination of options.

A special order may be canceled for a full refund only before it has been submitted to the manufacturer or supplier. After submission, deposits and payments are nonrefundable unless:

  • The supplier cannot fulfill the order;
  • We approve the cancellation in writing; or
  • A refund is required by applicable law.

Estimated lead times are not guaranteed completion or delivery dates.

8. Product Availability and Shipping Delays

Inventory and supplier availability may change without notice. A product shown as available may sell out or become backordered before an order is processed.

We will provide estimated shipping or delivery information when reasonably available.

If an online order cannot be shipped within the promised timeframe—or within 30 days when no timeframe was provided—we will notify the customer and offer the choice to:

  • Accept the revised shipping timeframe; or
  • Cancel the unshipped order for a full refund.

Manufacturer production time, freight transit time and local delivery scheduling may be separate stages of an order.

9. Delivery

The customer or an authorized adult must be available at the agreed delivery time unless other arrangements have been approved in writing.

Before delivery, the customer must provide:

  • A safe and accessible delivery path;
  • Accurate information about stairs, doorways, elevators, gates and other obstacles;
  • Permission to access the property;
  • Adequate space for the product and installation crew; and
  • Any required building, property-management or homeowners-association approval.

Additional charges may apply when delivery requires unexpected labor, special equipment, additional trips, storage, difficult access or services that were not included in the original quote.

The customer is responsible for measuring doors, hallways, stairs and the intended installation area unless we agreed in writing to perform a site inspection.

Risk of loss passes to the customer upon completed delivery, except for damage caused by our delivery personnel or as otherwise required by law.

10. Installation and Site Preparation

The customer is responsible for ensuring that the installation location is structurally suitable, accessible and properly prepared.

Depending on the product, site preparation may include:

  • A level and load-bearing floor, slab or foundation;
  • Adequate room dimensions and cueing clearance;
  • Required electrical service installed by a licensed electrician;
  • Plumbing, drainage, ventilation or water access;
  • Required permits and inspections;
  • Clear access to the installation area; and
  • Removal of existing products or obstructions.

Unless expressly included in writing, our installation services do not include electrical work, plumbing, structural modifications, concrete work, permit services or repairs to pre-existing property conditions.

If the site is not ready or safe when our crew arrives, we may reschedule the work and charge a return-trip or additional-labor fee.

11. Service, Repair and Moving Work

Service estimates are based on the conditions and information available when the estimate is provided.

Hidden damage, missing components, prior improper repairs, structural problems or conditions that could not reasonably be identified beforehand may require additional work and charges. We will request authorization before performing material work beyond the approved scope whenever reasonably possible.

Customers must disclose known damage, hazards, access restrictions and relevant repair history before service begins.

Service charges, trip charges, diagnostic fees and labor already performed are nonrefundable.

Any workmanship warranty will be limited to the terms stated on the applicable estimate, invoice or service agreement.

12. Customer-Owned Property

When providing moving, repair, installation or maintenance services, we will use reasonable care while handling customer-owned property.

The Pool Table Dr. is not responsible for:

  • Pre-existing damage;
  • Normal wear, aging or deterioration;
  • Concealed defects;
  • Damage caused by improper prior installation or repair;
  • Weak, damaged or unsuitable flooring, walls, stairs or structures;
  • Customer-provided parts or materials; or
  • Damage resulting from inaccurate information or an unprepared installation area.

Nothing in these Terms excludes responsibility that cannot legally be excluded.

13. Inspection and Damage Claims

Customers should inspect products at delivery or pickup.

Visible freight damage, missing pieces or incorrect products should be noted on delivery documents whenever possible.

Please include your order number, a description of the problem and clear photographs. Keep all packaging and damaged merchandise until we provide instructions.

Failure to report concealed damage within 48 hours does not eliminate rights provided by applicable law or a manufacturer’s warranty, but prompt reporting helps us pursue freight and supplier claims.

14. Returns, Refunds and Exchanges

Returns, refunds, exchanges, restocking fees and final-sale items are governed by our Return and Refund Policy:

Our Return and Refund Policy is incorporated into these Terms.

Special orders, custom products, installed products, opened chemicals, clearance merchandise, floor models and used products may be final sale as described in that policy.

15. Manufacturer Warranties

Many new products are covered by warranties issued by their manufacturers.

Manufacturer warranties may require product registration, maintenance records, photographs, diagnostic work or direct communication with the manufacturer.

The Pool Table Dr. may assist with a warranty claim but does not control the manufacturer’s coverage decision, replacement-part availability or processing timeframe.

Manufacturer warranties are separate from any written workmanship warranty provided directly by The Pool Table Dr.

16. Cancellations Required by Law

Nothing in these Terms limits a customer’s cancellation rights under applicable law.

Certain transactions completed at a customer’s home, workplace or another location away from our regular place of business may qualify for a legally required cooling-off period. When such a right applies, the customer will be provided with the required cancellation notice and instructions.

17. Website Use

You may use this website only for lawful personal or business purposes connected with reviewing or purchasing our products and services.

You may not:

  • Use the website for fraud or unlawful activity;
  • Attempt to interfere with the website’s operation or security;
  • Introduce viruses, malware or harmful code;
  • Scrape, copy or commercially exploit website content without permission;
  • Submit false reviews, orders or account information;
  • Impersonate another person; or
  • Use the website in a way that violates another party’s rights.

We may suspend access, cancel orders or take other reasonable action when these Terms are violated.

18. Intellectual Property

The Pool Table Dr. name, logo, website design, original photographs, written content, graphics and other original materials are owned by or licensed to The Pool Table Dr.

Manufacturer names, trademarks, photographs and product materials belong to their respective owners and are used for product identification and authorized sales purposes.

You may not reproduce, modify, distribute or commercially use our website content without written permission.

19. Reviews and Submitted Content

If you submit a review, photograph, testimonial or other content, you confirm that:

  • You have the right to submit it;
  • It is accurate to the best of your knowledge;
  • It does not violate another person’s rights; and
  • It does not contain unlawful, abusive or deceptive material.

You grant The Pool Table Dr. a nonexclusive, royalty-free right to display and use submitted content for website, customer-service and promotional purposes. We may remove submitted content that violates these Terms.

20. Third-Party Services and Links

Our website may contain links to manufacturers, payment processors, financing providers, shipping companies, social-media platforms or other third parties.

Third-party websites and services are governed by their own terms and privacy policies. The Pool Table Dr. is not responsible for third-party content, availability, security or actions.

21. Privacy

Payment information submitted through Shopify or another payment processor is handled according to that provider’s security and privacy practices.

22. Disclaimer

We make reasonable efforts to keep the website accurate, secure and available. However, the website may occasionally contain errors or experience interruptions.

To the fullest extent permitted by law, the website is provided on an “as available” basis. We do not guarantee uninterrupted access or that every website error will be immediately corrected.

This disclaimer does not limit any express written product warranty, service warranty or right that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by law, The Pool Table Dr. will not be liable for indirect, incidental, special or consequential damages resulting from:

  • Use or inability to use the website;
  • Delayed supplier production or freight service;
  • Third-party websites or services;
  • Customer misuse, neglect or unauthorized modification of a product;
  • Failure to follow manufacturer instructions; or
  • Conditions outside our reasonable control.

Our total liability relating to a product or service will not exceed the amount paid for the specific product or service giving rise to the claim, except where a different remedy is required by law.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence or any liability that cannot legally be limited.

24. Indemnification

To the extent permitted by law, you agree to reimburse The Pool Table Dr. for reasonable losses, claims or expenses caused by your unlawful use of the website, violation of these Terms or infringement of another party’s rights.

This section does not require a consumer to compensate us for our own negligence or unlawful conduct.

25. Events Outside Our Control

We are not responsible for delays caused by events outside our reasonable control, including severe weather, road closures, natural disasters, labor disruptions, supplier delays, freight interruptions, government actions, utility failures or other emergencies.

We will communicate material delays and work in good faith to reschedule delivery or service. Any legally required cancellation or refund rights remain available.

26. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Before filing a legal claim, both parties agree to make a good-faith effort to resolve the issue directly.

Unless applicable law requires otherwise, legal proceedings relating to these Terms or a purchase from The Pool Table Dr. must be brought in a court with jurisdiction in El Paso County, Colorado.

Customers may also use any consumer-protection process or small-claims procedure available under applicable law.

27. Changes to These Terms

We may update these Terms to reflect changes in our products, services, website practices or legal obligations.

The revised Terms will be posted on this page with an updated date. Changes apply prospectively unless applicable law allows otherwise.

28. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

29. Entire Agreement

These Terms, together with the policies and written agreements referenced within them, form the agreement between you and The Pool Table Dr. concerning website use and online purchases.

A separately signed estimate, invoice, sales agreement or service agreement may contain additional terms. If a signed written agreement conflicts with these website Terms regarding a specific transaction, the signed agreement controls for that transaction.
